I received an RFE for my EAD renewal.
It says "Please submit proof that you have filed an I-485 Application"
I have a copy of my receipt of I-485. Would that be enough to send? Why would they ask for proof of I-485? This is my second EAD renewal.
Please let me know.

USCIS is like a child. Just want to hear that from you saying that "I filed I-485" everytime. They belive the xerox copy of 485 you send than the information in their computer.
Keep it as a practic to 'bold' the statement "I filed I-485" + copy of the notice everytime you communicate with USCIS.

My friend got EAD.His wife is on F1 visa.If he starts using EAD instead of applying for H1 extension, Can he able to join his wife to his GC process who is currently on F1 when his priority date become current.His priority date is Sept06.140 Approved.july 2, 2007 filer.485 is pending.

Yes, as long as the derivative I-485 is submitted before the primary applicant receives approval of his I-485.

Hello all,
I am an Indian national currently in the AOS-pending state. My wife & I are looking to adopt a child either from India/US or a different country. From what I have found out, this seems to be a herculean task. Is this even possible? Has anyone successfully completed this process, or know of the details/steps involved. Any information is appreciated.

Hi,
I 've applied for my H1 extension in August 2009 (Just two weeks before my previous I-94 was expiring), after a month I have been facilitated with RFE for client letter. As usually my client denied providing me a letter and told me to contact primary vendor for any of this kind. Finally got a letter from primary vendor with roles and responsibilities of mine with very extended duration. RFE was answered with the primary vendor letter, and after couple weeks extension was denied.
Now my previous H1 got expired two months back, initially my employer told me that he will open MTR but attorney suggested that chances of MTR success is less and asked to file new application for extension. Another application (premium) was filed within 2 weeks of first application denial and after couple weeks my extension was approved.
1. will the period between initial H1 expirey date and approval of 2nd application for extension considered as "out of status" ?
2. Had to visit india and need to go for stamping, how is mexico in my case?
3. I heard that due to not having an entry in PIM, applications are kept pending for 4 to 6 days in india with 221g. How about mexico, will it be same?

My wife is currently on H4 and she is planning to apply for Residency here in the US on an exchange visa (J1). Let us suppose that she gets her status adjusted here in the US from H4 to J1 and then travels outside the US (say India). Then, she would have to get a J1 visa stamped on her passport. Considering that her spouse (that's me) would be on H1B, it would be rather difficult for her to prove that she would return to India. Do you think there is a greater chance of denial of J1 visa to her at the US consulate? If yes, how do you recommend we go about doing it? Your answer would be appreciated.

The red flag is usually raised when one has immediate relatives who are Citizens or Green card holders. If you have a spouse who is on H-1 it does not mean that you intend to immigrate to the United States. However, the fact that you filed for an immigrant petition might effect her visa application adversely, the consulate is capable of rejecting for any reason and no judicial review exists if the visa is rejected. Big mistake. Yes, your lawful stay in US ends on 30-Sep-2007.
With the Visa from company A expiring on 30-Sep why did you travel without getting the H1 papers from company B in hand?
You should have done either of the following
1) Got H1 stamping from company B before entering US (or)
2) Entered US with company A’s VISA (before it’s expiry) and company B’s H1 approval notice, so that the officer could stamp the I-94 as per company B’s end date.
All that you can do now is to leave the country before Sep 30th and renter US with VISA stamping from company B.

H1B petition filed for H1B extension in regular processing on Nov 14 2007 in CSC and on 16th USPS has acknowledge that application has been delivered to USCIS and signed by GERORGE. I haven’t received receipt number till today. Is there any delay for receipt notice?

Celebrating the good news here.
Question: Did anybody receive confirmation about their AOS applications being returned after filling in early July (Say on the 2nd or 3rd)? I know there have been rumors about a few returned applications but I haven't actually found anyone in such situation + my attorneys confirmed today that USCIS specifically instructed not to return/reject them.

My cousin sister told me yesterday that - many are shy. Especially men - men could be the shyest people when it comes to showing up in public.
Yes, a big reason for people hiding inside closets is shyness.
This is also called social inhibition - UNABLE TO INTERACT SOCIALLY IN PUBLIC.
COME ON FOKLS - LETS ALL BE REAL MEN - LET THE WORLD KNOW THAT YOU EXIST. YOU HAVE TO OVERCOME YOUR SHYNESS
A LOT OF WOMEN ARE DOING SELFLESS HELP AT IV - THESE WOMEN ARE BRAVE - THEY WILL ONLY APPRECIATE BRAVE MEN - SO IF YOU SHOW UP YOU WILL BE APPRECIATED BY ALL THE GREAT WOMEN AT IV.

Hi All,
I applied for Labor in EB2 category in Oct 2007. It was pending for 2 yrs and 2 days back my employer mentioned that they see my Labor status as denied and that they have not received any denial letter yet.
My H1 will expire in early Jan 2011, so I practically have around 365 days from now to apply for a new Labor. My questions are
1. Should I re-appeal?
2. Do Labors get approved in re-appeal?
3. Can I start a new Labor application with the same employer simultaneously?
4. What�s a safe category to apply at this point in time. EB2 or EB3?

i know the character as being chinese (but it's probably definately a japanese one as well). and it means to "paint/draw" so it has huge relevance to kirupa.com. as far as the stamp goes - it could be a little more interesting. it's kind of too white and plain-jane. (and what stamp costs $0.00?) the text is a little blurry as well
