Greg Siskind (following the original link) is not sure if there is a trend here, but it seems to me in recent years there is a perceptible shift in the occupation of these fraudsters, moving upscale from small-time crooks to the ringmasters who are supposed to help enforce immigration laws.

There is just one thing you can do......pray........however gods immigration dept is as slow as USCIS............IV community will attest to that:)
Ofcourse you dont need approved h1b to leave the country......only to come back..so if you will be there for a few weeks you can get PP done till then........make sure stamping etc is taken care of before you show up at POE.........

You can not use interfiling across categories. You can only use interfiling between few EB categories. You are better off moving to family based quota, all you need to prove is she is your sister. Good luck.
People in this forum are struggling to get GC on Employeement category, since you have a family stream possibility and which is current as per you note above, I would advise you to help us by moving you and your husband to family category.......thanks in advance for giving us 2 visa numbers. :D

Hi,
Here is the my status:
- 140 approved(EB3 category)
- I am in 7th year of my H1
- 3year H1 extension is in-process
All of the above with Company-A.
If the 3year H1 is approved, will I be eligible to change job to Company-B and transfer my H1 to Company-B?
Can I take my priority date from my application from Company-A to B?
In what way Company-A can affect my status once I switch to Company-B?
Thanks for your input.

1) If I work for a company A ,Can I get my Green card processed by Company B by future employer option
2) If so when do I have to leave company A or is there any way I can continue with Company A and get my GC processed through company B.

because i was getting conflicting opinions, i consulted an immigration attorney from a big law firm. here is what he says:
You can start working as soon the new company receives the h1b receipt notice.AC21 portability can be applied to H4 to H1 as well.

(a) the nonimmigrant was lawfully admitted to the United States; (b) the nonfrivolous petition for new employment was filed before the end of their period of authorized stay; and (c) the nonimmigrant has not been employed without authorization since his lawful admission to the United States, and before the filing of the nonfrivolous petition."
Based on above information. I would assume that its safe to start after getting the h1b receipt notice. This is for other people in similar situation so that they get the right info.

I was in united states for 5 years and 2 months on H1-B visa. I did not apply for green card during my stay and had to return to India in Aug'2008 due to personal reasons. I want to find out if I am eligible for applyng H1 in this year's quota through same employer with whom I had earlier H1.

It all depends on their background check and security requirements.
As a non-US citizen your EAD has the same worth as a H1B for these jobs. Same is the case for LPR's for US Federal jobs with various security clearance checks (where only US Citizens can apply).
I know contractors who work without citizenship, but for a employee it looks like US Citizenship is a basic necessity. Do you have any first hand knowledge? Thanks in advance.

I understand I can�t invoke AC21, but I was reading somewhere that � if you are changing your sponsored company and found same or similar job, then and then you need to file AC21, in my case my sponsored company is still same and ones I got GC, I will start working for them (like future employment).

no issues. My mom travelled to mumbai from chicago via frankfurt on AI. everything went well.. no issues on wheel chair as they took care of her well in transit and dropped her at the gate.
She did report issues in mumbai when she landed as it took 30 mins for wheel chair person to arrive at the gate... same AI has pathetic service in india and they are OK in US.

You can check with the airlines and ask for wheelchair for you aged parents ... usually I have seen with Lufthansa - they provide a very good service when you ask for special assistance. Not sure what BA will do though ... you can always try ....

Ask yourself this question. Are your air miles worth more to you than getting your green card?
There may be some members who will make it to the event if they get their tickets sponsored. While we can sit all day and talk about the reasons they should pay for their own tickets, lets keep that aside and get something done. At least they are willing to come if someone sponsored their tickets.
To help these folks, donate your air miles. This will help to sponsor their tickets and make the advocacy day a success. it will move you closer to getting your green card.
If you are willing to trade your air miles to get your GC sooner by resolving all the current issues, go RIGHT NOW and post your intention in the thread to donate your air miles. It is worth it.
