I have been following IV ever since itz inception and I really appreciate all the efforts by volunters.
However, I feel we have up-hill battle in this current political and economical situation and we need to re-think about startergies and solving current retrogession.
I just want initiate brainstorm, I am not sure if these ideas are discussed before,
Having seen how CIR bill is killed in House, I am very doubtfull about SKILL bill getting passed in house.
getting any pro-immigration (legal/illegal) is a long processes, so can we need to focus on what we can do to reduce the retrogression within current legal framework
like
lobby senators to enforce USICS on following
- Reduce time taken for Security Checks
- Try to consider 245i cases in a different catagory than EB3
- Try recapture unused visa numbers from 2003-04-05
- issue EAD/AP for three years
- remvoe per country quota
- allow to apply for I485 if I140 is approved, ( I know this is controvesial but we can try)
These simple things could reduce retrogression if not completly resolved

If the employer agrees not to revoke the 140, Can I change the employer after getting EAD. 485 application is pending but less than 180 days.

I mailed my I-765 along with cashier's check for $340 on dec, 17 , still waiting for receipt notice. I call customer care number today since its more than 30 days, but they are closed today.
I have USPS confirmation that they have received case on Dec 19.
I will try calling them tomorrow.

Will be hard to give correct answer because we don't know what was his status since H1B approval & now (more than year period). If he went went out of country & returned to USA during this period, He is fine with his L1 Status.
As far his H1B approval has valid period, he should be OK to work with H1B sponcer employer as far as he maintained valid status. He might need to go out & get H1B visa stamping before he starts works.
But one thing is sure, He won't be part of H1B Quota limit for his next H1B.

In delhi consulate when I click on Indian resident I see the available dates but when I click on Indian citizen residing in US, I see no availability. I'm not sure which option should I choose. I'm a student working on OPT in US. My OPT will expire on Aug 4th and so I will come to India. I'm not sure which of the two options I have to choose while scheduling an interview :

Hi immigration Gurus,
I am in kind of situation where I need the guidance from the experts and knowledgeable . I was working for a company A(IT Product development company) who filed my GC around FEB 2007 in EB2, Aug 2007 filed my I140 and I485 concurrently, In Oct 2008, I left the A Company and moved to Company B on H1B,the company B immigration lawyers did not file AC21, as there reason was we don't want to get unnecessary attention on the GC process and told if any any RFE we will look at it, right now I got a good offer with Company C and have to move for a better medical insurance. Looking at the GC Labour petition, it is given as a product manager with the Company A and the OES code is pointing to some manufacturing production manager as there is no such as product manager in the computer OES code. Right now the company C I am moving is a Technical Lead position, so how to go about or is there any advice for this, if I am moving on the EAD and how to file the AC21 so that I don't get any RFE.

Hello, I have read about the 485 180 days rule and how one can use AC21 after 180 days have elapsed. But if one loses their job a 2 mths before the 180 days are over, is there a possibility of continuing the 485?
- Can one be unemployed and just wait out the 180 days before invoking AC21?
- Can one transfer to another employer on H1 (but let USCIS know after 180 days have elapsed)?

My employer says its the company's policy not to file for EAD or AP for all its employees. They are just filing the 485. I am sure that they(employer and lawyer) will not be giving me the 485 reciept too.

You cannot work beyond the last day of your OPT work authorization.
You say you are going to apply for an H1. This can only be done by an employer who has already fulfilled a labor conditions application on your behalf.
Once your OPT finishes you cannot just stay in the US to wait and see what happens. You will need to leave and if your visa application is approved you can get a visa stamp at your local US consulate and enter the US again within two weeks of your first date of employment which cannot be before October 1st 2009.

Hi,
I Think you need not worry. Air-india will stop in paris for 1 or 2 hours for fuel. They will not allow you to get down from flight. So, technically no stop in paris. I came through air-india last week. No need of french visa. Go by what air-india says. Regarding NJ-Newyork.. let others can answer. No problem as long as u have full AP Papers.

There may be other avenues to get AP for a longer period. EAD nothing to do with your 485 processing. Without EAD you can get AP if 485 is pending.
